A simple will is all that the average young or middle age person or couple needs. Commonly it provides for couples to leave all that they have to each other and if neither survives gives it all equally to the children. If the children are not self-supporting adults it would provide for a trust to be administered by a close family member or friend for the benefit of the children until they are can handle their inheritance. Seniors may have different situations that could require a different approach. However, I will not draft a trust to avoid probate or to make a senior eligible for medicade which deprives seniors of the dignity of owning their life savings in an effort to make them eligible for public assistance in their declining health years. There is still a place for a Will to be probated to transfer their life's savings to a family and friends and also provide for their care as their health declines. A carefully drafted Will probated by the local Surrogates Court in most cases, inexpensively addresses a senior's wishes. Taxes are not an issue unless you have more than 4 million dollars in assets.
